The dealer and the salesperson have responsibilities to address when a salesperson’s employment ends.
Responsibilities of the Salesperson

Responsibilities of the Dealer
The dealer is responsible for a salesperson’s actions in motor vehicle sales until the board is notified of their end of employment. Dealers should immediately notify the MVDB once a salesperson is no longer employed.
Surrendering Salesperson License
Upon termination of a salesperson, the Dealer should make every possible effort to obtain the salesperson’s license and send it to the Motor Vehicle Dealer Board. Please write “TERMINATE” on the license, sign and date it. If you use the MVDB 41 , attach the terminated license directly to the form; otherwise, include the relevant information in your correspondence as indicated above in Step1, item 2. If the Dealer is unable to obtain the terminated salesperson’s license, the Dealer must communicate this to the Board by email, so the Board’s records can properly reflect this.
Notifying the MVDB of a Salesperson's End of Employment
Dealers can securely email either a completed MVDB 41 or an email with the subject “Salesperson Termination”, including the salesperson’s full name, license number, and termination date in the body of the email, to dboard@mvdb.virginia.gov
1. We strongly encourage the use of encryption when submitting personal information via email. Some examples of software that facilitates this are Virtru and SecureMyEmail. Pursuant to our Disclaimer of Liability, we recommend consumers do their own research and find an encryption service that suits their needs.
Virginia law (§ 46.2‐1518) states in part that the Dealer must notify the Board “not later than the tenth day following the month of the termination”. Dealers should not wait until the renewal period to notify the Board of a termination.
